I don't believe it is free speech regardless of a Supreme Court designation. I understand that all forms of speech are not necessarily oral in nature. You are arrested for being an arsonist if you burn a building. You are arrested for burning our forests. You should be arrested for burning the flag. I believe the flag is the emblem of freedom and the symbol of unity.
The raising of the Flag on Iwo Jima, the raising of the Flag on the Moon, the salute to the Flag and the playing of the Star Spangled Banner before games and ceremonies, our declaration of Flag Day, are lessons we need to impart to the next generation so they don't forget. It represents what mere words cannot express. It is not just our duty; it is our duty to every American serviceman and servicewoman who fights for our right to Free Speech and every right they believe in.
I came to understand that it is beyond the obligation to their families that inspires them to do what they do. It is for their families to enjoy something the rest of us take for granted. They know there is a greater good out there even if we have blinders to see it.
Sometimes our patriotism is that last ounce of Hope that drives us beyond our normal capacity. If that Flag inspires that last ounce of Hope, don't let anyone stand in Its way, especially one who doesn't understand what it means to be knocking at death's door.
Even free speech has to know its limitations. I cannot call someone terrible words that malign their race, their ethnicity without it being a crime. Congress saw fit to limit how far speech can go in that area. They call them hate crimes. So why does that not apply to the flag that is draped over the coffins of our military service people.
Sorry, I never served in the service. But if you want to know what it means attend a military funeral. The draping of the flag, the giving of the flag to the family of whom the person who served this country gave it all, the 21 gun salute, the bullets from that salute, the playing of Taps, the gravesite among their brethren...will forever change your life and perception. I promise you, you will walk away a humble person for they have arrived "home."
Flag burning has risen these days to demonstrate the hatred for the new race called Americans, not just politicians.
For those reasons I believe that we need to pass an amendment specifically banning burning the flag. The detractors would say we would be opening the floodgates to ruining the protections of free speech. I don't see it that way. I see it as an extension of what we define as hate crimes. If there is another symbol that demonstrates our patriotic beliefs which can be attacked show me. We even protect the eagle.

People are right our flag does represent everything our country was founded on, and everyone our country was founded by.
Our country was founded by people who disagreed with their government to the point where they were willing to die for it. Burning the flag is the ultamite demonstration of disagreement with your government. Not nessecerely your country, but your government. There is a big difference.
In short the burning of the flag does not hurt anyone at all, and therefore should not be made illegal.

For all those concerned about burning flags, I think you should re-read the 1st & 2nd Commandment AND the 1st Amendment.
Nothing is so sacred as God, and to create a law that upholds an idol as more sacred than God is pure blasphemy. God, family, country, in that order. People forget that.

not a criminal act. disrespectful, but the whole point behind it is to protest by being disrespectful. technically, it falls under the "peaceful protest/assembly" clause of the first amendment because no one is being hurt, attacked, or threatened by a flag burning. people might be offended, but there are a lot of things in this country that offend different people and virtually none of them are illegal.
i would never burn a flag, but in my opinion, it's a tri-colored piece of cloth that is merely a symbol of this country. a symbol is something that represents the country, but only a small portion. america is so much more than a flag.
and i guess the whole ideology behind flag burning (speculation, on my part) is protesting what is seen as something that is violating their rights. i don't really see it as being unpatriotic, is what i'm trying to say. i am trying to put myself in a flag burner's shoes...it's sort of like saying, "this flag claims to represent something that it isn't. this flag represents the lie of freedom" and burning it out of protest. it's sort of like burning the false america. saying we aren't as free as we are.

Flag burning, while despicable, is free speech. I heard a senator say something along the lines of "men and women gave their lives to protect this flag, the least we can do is protect it ourselves." While that is a noble sentiment, the truth is that no one ever gave their lives to protect the flag, they gave their lives to protect what that flag stands for, and for better or for worse, part of what that flag stands for is the right to burn it if you please. Please do not interpret what I am saying as supporting flag burning, just supporting free speech.

Criminal Act, should have a good penalty like minimum 1 year imprisonment.
If someone burns the flag of another nation, it is disrespectful. and should have a penalty, not as severe as the first one.

Every minute of every day the United States Postal Service deliberately defaces and desecrates millions of flags on postage stamps.
