I am pretty sure he will actually need to sign a form for the name change to be legal.

If you mean that because he signed the birth certificate, your child's last name is the same as his - I don't know that that is even right. In Ohio, the last name of the child is the last name of the mother unless the mother and father are married. You just need to check with city hall. Since you weren't ever married, and the child is a minor, it could be as simple as filing a name change with the civil court. Make a phone call or two. Later, if you find someone you want to marry, that person can adopt the child and give the child your new last name as well.

Well, first off, if he ever gets out...
You will never be able to live with him, and have your child in the same house!!
And, if you DO decide to live with him, with your child in your house, then YOU need to have your HEAD EXAMINED, and the Child Protective Services should take your child away from you!! Simply because you cant exercise good judgement, from keeping your child safe from a Sexual Predator!!
I dont care if he is the father or not, he is a Child Molester, and its not safe to keep a child in his presence...
Get the Courts to intervene with you and you will prevail...if you have a reasonable cause, like you divorce your husband and he relinqueshes custody of your child and you marry some one else.
But, having your child's name changed, just because you dont like her father at this time, I dont believe is a reasonable request by the Courts to do this, unless some one was wanting to adopt her...

If his name is on the birth certificate, then you have to go through your county court system, tell them he is in jail and get his permission. Sorry, and Good Luck....
