Her husband (a little too high strung right wing) moved her out when she was at the lake with friends one day last week. Now he has cut off all her cards and won't give her possession of their house. They have 5 small children! She is not much of a stand up for herself type, but she knows she has to file divorce to get her house and kids back. Any advice is MUCH appreciated, thanks!

Kansas is a Division of Property state... different from Community Property.

You can find some basic info on divorce in Kansas here:

http://www.ksbar.org/public/public_resources/pamphlets/marriage_divorce.shtml

http://www.ksbar.org/public/public_resources/pamphlets/divorce.shtml

http://lawlibrary.jocogov.org/pForms.htm
(Public forms for divorce with and without children. Although it's for Johnson County, Kansas, it's suitable material statewide)

http://www.kscourts.org/dstcts/4faqs.htm
(Frequently asked questions... includes questions about divorce)

http://www.jocofamily.net/index.asp?DisplayPageID=114
(Agains, Johnson County, but it includes general Kansas law)

There is also a Johnson County Family Law Guidelines with a section on Division of Property chapter at:
http://www.jocobar.org/pdf/guidelines2005.pdf
Unfortunately every time I try to search this online document it crashes my Internet access!

Kansas is not a community property state.
There are only nine states in the U.S that are. But he cannot deprieve her of her children,or home.
She needs to bring that up to her lawyer(try legal aid)That kind of abusive, controlling behavior won't look good to any judge.
