We are having alot of trouble with our landlord. He says that we haven't paid rent for thirty days (we have the cancelled checks that says that we did). He issued a hand written eviction notice saying that we have to move in ten days for nonpayment of rent. Is the notice legal?

Call the county attorney's office in your city. He should be able to tell you over the phone. Then I would definitely start looking for another place right away. You don't want to rent from someone like that, do you? Definitely get a copy of the check and show it to the landlord. Maybe he really doesn't think you paid?

You can check with the County and State offices in Arkansas. In Minnesota, you can download the Tenant's Renter's Rights from the State of Minnesota web site. The state of Arkansas should have the same. Good Luck!

NO!!!

GO to http://www.nolo.com and it will show you what your rights are as well as the procedures for them to evict you.

Where I live (GA), they must file a writ, and 3-7 days later you can be evicted. I doubt that what they are trying to do will stick, and you can take them to court if they do evict you.

Check out this site, and see what it can offer you. Might not hurt to consult local legal counsel for advice.

All you need to do is talk to a real estate lawyer!
They will get it straightened out for you!

Sometimes a simple letter from a lawyer is enough to stop someone from wrongdoing!
