What makes you think his scam would be legal in India? Or that he really even is from India? Spam usually contains fraudulent identification specifically because it is illegal. Nigerian 419 scams are called those because 419 is the code section in Nigerian law that those people are violating. We have many laws against fraud in the US, but people still commit crimes.

have loads of email like that from india nad nigeria and don't even open them
they're all scams
