I am not familiar with this law, but no I don't think that it matters.
I have joint custody of my boys ( i am the mother), they primarily live with him because I could not afford the house and he makes $25/hr I make $10, and they are trying to make me pay $500 a month. It sucks unless you have a lot of money for a good lawyer.
