If I am sitting at my desk--WHILE AT WORK--with a toothpick between my teeth and my bottom lip, straight up and down, and use said toothpick to poke my nose repeatedly when suddenly, a coworker surprises me from behind and causes the toothpick to go up into my nose, causing injury, bleeding, etc.?

Injuries covered by Worker's Compensation are limited to those sustained while performing work-related tasks while "on the clock". This does not cover injuries that arise from the misuse of tools or objects within your work environment or during your work duties.

In short, your use of the toothpick was outside your work duties and your misuse of such toothpick caused injury. No, you are not covered.

Its worth a shot, but their gonna wonder why it was so close to your nose to begin with and bring out differance it would've made if you were working the way you should've.

But then, it is possible to do more than one thing at the same time depending on what your doin.

Oddly enough you can. I woulnd't say that you were playing around but rather that you were using a toothpick.

Anything that happens to you on work property can be claimed unless it's proven that you were neglegent ie: walking on a wet floor that is clearly marked "wet floor use caution". And even then you can still fight and most likely win.
