I work for Domino's, and my boss is a jerk. If someone doesn't go to work on payday, he refuses to give them their paycheck untill 3 days later. Well, I requested July 14th off about two months ago, he hasn't told me that I can't have my check, but I am still thinking about it. It's not like I am surprising them by calling in on the day, because they had about 3 months warning, is it legal for him to hold my check? I am going on vacation and I really need the money for gas, food, etc. so I am going to get my paycheck one way or another. Just please let me know if what he is doing is legal, especially since it is an internationally known franchise. Thanks.

It really depends on the state, as each state has its own laws about such things.

Withholding pay as punishment is not legal. Yet, there is probably nothing you can do about it. If you can go in on the day in question and get your paycheck, then quit... you'd at least have your check. Otherwise, it appears your boss will sit on your check for however long he feels like it. If your boss withholds your check, you could report him to your local newspaper or local tv news... they could do a story and perhaps create enough local pressure for you to get your check on time. Of course, it is likely that your boss will "magically" find a reason to fire you.

Perhaps you should consider delaying your vacation until after you've been paid...particularly if quitting is not an option you're considering.

It really depends where you live. In Canada, employers are allowed to withhold payment for 5 days and employees only have the right to complain after payment has been withheld for 6 months...which really sucks if you're dependant on those pay checks. I'm not sure what it is like in the states but I'm sure employers do have the legal right to withhold pay for a certain time. Check your specifc state labour laws.

The short answer is "Pizza Hut!"

The longer answer is "Get a job at Pizza Hut!"

The longest answer is:
I have no idea. I do know that if you work in Ohio, and you quit your job, you can do so any time with no warning or notice, and they have to pay you everything they owe you by end of business that day. I read that in the ORC, but never have seen it happen.

Check with your state/province on this. Usually there is a number you can call for their labour board and you can ask away there. It wouldn't hurt to report this to Domino's head office either. Speak to an HR representatitive to find out what's going on.

You have every right to fail a complaint with your local labor commission and I would to teach that fool a lesson.
