You are 100% liable. However, it is simple to add the other driver as long as he/she has a valid license. Unless they are under 25 years of age (at least in California, there is no addtional charge. Car rental agencies also offer auto insurance for a daily fee that will cover all signed up drivers. My advice: be
honest and sign up the other driver. If they are given a traffic ticket, and the car rental company finds out they were driving, it could mean that they would not rent to you again. Do you need the hassel?
