its unethical and an invasion of privacy. Its like looking at someone's checkbook or diary.

Yes. Unauthorized access to a computer system is a crimminal offense at the Federal level and at most state levels as well.

I'm fairly certain that you can, I dont know if it is a federal offense like reading someone elses snail-mail is. If not, its still ethically wrong.
