In 1991, McVities was taken to court by HM Customs because chocolate covered biscuits are classed as a luxury item and are subject to a higher band of tax. McVities proved that Jaffa Cakes were in fact cakes, arguing that the distinction between cakes and biscuits is simply that cakes go hard when stale, whereas biscuits go soft. It was demonstrated that Jaffa Cakes become hard when stale and McVitie's won the case.

There was a big kick off with the eu over this, they said it was a cake and mcvities said it was a biscuit, or the other way round, anyway, mcvities won.

It is a cake, it is a sponge, it has egg in it which makes it more fluffy and light. Biscuits dont have egg in them.

its a cake. firstly name is jaffa CAKE, 2nd, it has an egg in biscuits don't and 3rdly my opinion is its a cake because i prefer cakes to biscuits and jaffa cakes are nice. hope i helped!!!
