The Catholic Church probably issued a declaration of nullity to her first marriage.

This happens when the Church discovers that the parties were not truly joined by God and hence a full spiritual sacramental marriage as understood by the Church was not present.

Some people incorrectly call this an annulment.

The answer is sad and amusing....

The Roman Catholic Church has a limited view of religion. Kidman's first husband is neither Catholic, nor a member of any other religion recognized by the Catholic Church. Therefore the marriage to Cruise is not considered to be a valid event of the sacrament in the eyes of the church.

Buddhism and as well as many other world religions are also not considered to be religions in the eyes of the church.

Good question I didn't think of that Catholics are very particular about that sort of thing. I'm surprised she could do that, divorced and certainly not a virgin. Oh well guess money and fame does take you a long way.
