I live in a suburban neighborhood with lots of trees. At dusk you can see and hear flocks of birds settling high in the tops of the tallest trees. Once they settle in, they vanish! You would never know they are there. Also, some birds head for deeper woods or more secluded areas for the night. You may not think there are any of those nearby, but the birds know how to find even the tiniest patch of deep woods.
As far as nests, just assume there might be a nest during nesting season - usually early spring to early summer for most species - and try not to disturb it. :)

Some nests are hard to see. I think most birds sit in trees during the night, away from cats and other bird eaters.

they stay in the nest. i guess by shaking the branches of the tree you would come to know if there are nests or no.

They usually go to roost in their favorite spots. I accidentally came upon a Robin roosting in one of my backyard trees at 9pm . Birds are very secretive about roosting for obvious reasons
