I have to court for the 2nd time on July 17 after three years from the first court date. I am trying to get an increase on payments. I pretty sure he is making more money. He has been with H.E.B for three years. Can I expect payments to increase or decrease if he has another child with someone else. They are not married and the other girl does not have him on child support for thier child. I am scared that I would get less. Right now I am only getting $41.00 a week. What do I expect on my court date. Please help this single mom.

Depending on the state, the court will use a "step system" to determine the amount each child should get. The first born gets more, the second less, the third even less and so on. They will account for the other child but the payments for your child should not decrease.

If he can show that he is paying child support for another child then you will more then likely not get an increase. They will not however lower the amount you will get. So worst case senario is you will get $41.00 a week

They will take his other child into account...just have your information ready (financial documents...paycheck stubs, etc) There is a formula that they will use. Payments should not decrease...if it has been three years..it is likely they will go up. It will depend on his income as well...

and don't spend the money an attorney for this....only get one if things go sour and you think you will really need one.

If you don't have an attorney, get one right away, because they can help you the most. Chances are, if he's bailing on some of the child support money, and you bring it before the court, you can probably get him to pay the legitimate amount.

the court must allow the same amount of money for each child, but if you can show your expenses have gone up over the last three years the court will adjust child support in accordence to his income.
