somebody I know well is in court this wednesday for possession of an offensive weapon namely a 8in. kitchen knife, in a public place.He was gate crashing a party or something.He has broken a conditional discharge he got for theft of a mobile phone.he's also up for a bag of weed.his previous aint too bad....Jail or no jail?

should've explained he's in england as there has been a heavy focus on knife crime especially in our city coventry

Unfortunately, yes, he's probably looking at a short stretch. A friend of mine is in court today - I don't know the charge because I don't ask - but he reckons he's looking at six months and thinks he'll serve 8-10 weeks with good behaviour.

Not nice is it?

Update: my friend 'got away with it' (his words not mine) so maybe yours will be lucky too ...

probably jail as

He can't argue he was a good kid scared and trying to defend himself as he stole the phone.

Likewise was the phone taken as a mugging or just lifted as someone stpidly left it on a table.?

When he gate crashed the party how did he behave? and did he leave if asked?

Did he threaten anyone

How big was the bag of weed? for own use, use for friends or dealing?

Was he a hippie or a gang member?



I can understand someone carrying a knife as scared or if rushing to the rescue of someone, or if getting bullied. Can even understand them stabbing a bully, thats fair...

But the judge will take the rest into account and it dont look good

This person caught a weapon charge....was told not to be in trouble again as a condition of discharging theft. Depending on the amount of weed, they could use one charge and dump the other. No more than 6 months he'll do, probably probation.

I say you hang with a tough crown. But I am not the one to judge. Him, he needs to be set straighter than he is right now. We all do dumb things once in a while. Yes it is up to the Judge. If I were the judge, based solely on what I just read, I would place him under house arrest for a year with 5 years extended probation. He'd have to go to counseling at his own expense. That would been getting a job, not selling dope. Almost everyone should have a second chance, but it sounds like he already used his up.

No he's not going to jail I dont care what he was going to do with it, because he did not use it on anyone , whatever he was going to do he didnt do it and probabbly regets it by now.
So dont worry he will be fine unless he's had a criminal record then you should worry, the police look on past history most of all.

Who knows but he should get 20years people like that are the scum of the earth and I cant stand them let people live there life and stop with all this crime I want to be able to go to a party and not get cut up and also have my car there when I get home is that to much to ask for.

I don't know. It seems to me kitchen knives should NOT be illeagal. Especially if he is cooking something. He DID have a bag of weed and stole a phone I guess. I personally don't think he should go to jail but I don't know the laws or how judges think.

I would say three months imprisonment here ... he really needs to be admonished here ..... what could he do next? But if I was on the bench, I would give him 250 hours community service ... let him put something back into society ..... much better than jail.

I think he might well go to prison. Breaking a conditional discharge is a sure way to get back inside.

It depends on what contry and state you are in. Here in NZ you will be charged but not much of a jail term
