Well that's up to the kids. Do you mean as far as a burial or cremation? I mean what are you asking? If the person had nothing when they died there is nothing for the kids to get but debt when they bury them. If the Kids don't want to do that the state will put them in a paupers grave some place.

If the person has no money or assets to pass on to the children, the kids get nothing. Since you say kids and not "adult children" I assume they are under age.

The children are eligible for state and/or federal assistance. The most likely aid will be for social security survivors' benefits. This would be a monthly amount based upon the earning the deceased person had while alive and paid in the SS system.

There would also be other government benefits, like food stamps and cash assistance that depends on each state.

If the kids are dependents, they should apply for Social Security benefits.

If they are not dependents or are over 18 and not disabled, they need to go to work or get some help.

First, the kids should make funeral arrangements for the person and calculate the expenses evenly because well, the deceased person is more important than who gets what - I hope you know that.

Then, the personal possessions should be divided among the kids.

bury him and split the cost among your siblings...

I do not believe children are responsible for the debts of their parents (usa), the estate will be put into probate and sold to cover outstanding debts.....
