you go in to a store and you want to buy a pepsi but you are thirsty so you open it and drink it and then pay for it is that legal

Not legal since you technically do not own the product. If a store employee stopped and asked if you paid for it, you cannot produce a receipt proving that you paid for the product since you never paid for the product. Not legal, stealing!

If I went into your house, pulled a sandwich out of the fridge without asking, ate half of it while we chatted (with no indication as to whether I would pay you later or not) and put the uneaten half back in the fridge, would you say that I was stealing the sandwich? Would you say I was stealing the sandwich if you didn't know me? Chances are that someone would call the police and report me as a thief. Basically the same principle, but a different place.

Just because "everyone else is doing it" does not mean that it is legal. If that were the case, we wouldn't have any laws and society would not be how it is now.

No, it is not. I've done this many, many times myself. I believe it's legal as long as you don't leave the store. I've seen people open up and start chowing down on a bag of munchies at the grocery store and then pay for it when they get to the cash.

It is legal but it comes down to a courtesy thing. Generally, I would have the money in hand and open the drink at the counter. That way the person behind the counter doesn't freak-out.

I have seen people at grocery stores do that. I have also seen them eat food and such before paying for it. It probably isn't the right thing to do. But I am only guessing that it isn't against the law. Just as long as you pay for it after you have had a drink or whatever.

You're only interested in the answer if the drink is Pepsi? Don't lots of places have drinks' machines outside that you have to put your money in before a drink comes out - um if you're lucky?

Technically you are drinking it before you actually bought it, so it is stealing. But it's nothing to get worked up about. Most stores don't mind if you drink it and then pay. At least you are paying for it at some point.

Well, that can still be considered as LEGAL. Because you do intend to pay for it. It will be not legal if your leave the store without paying it.

I worked in a store for several years and for a while we had a little sort of a promotion going on--reach in and grab a Coke and there was even a holder in each of the shopping carts for the bottle, and it said to enjoy your Coke while you shopped and just to remember to pay for it before you left.

It is tolerated at many stores. I know of no law against. But it could be construed as shoplifting, although strictly speaking shoplifting involves leaving the store without paying.

It is in fact stealing: The property (the Pepsi) is not yours until you have paid for it. The fact that you are willing to pay for it is merely mitigation. It is highly unlikely that the store would prosecute you, but they might ask you not to return (in future you would be a trespasser and eligible to be ejected).
