My husband and I got married in April 06. After discussing it, we would like to get a post nuptial agreement. Is there anyway to do this cheaply without getting a lawyer and going to court? Can you download the forms online and just get them notarized? We live in Indiana. Thanks so much!!

To JonnyC and Sweetask.....

I did not ask for marriage advice! I do not care what you have to say about me, my husband, or our marriage. We have our own personal reasons for wanting to do this. Clearly you do not know anything about it, so why dont you stick to answering questions that I actually have knowledge about!
To everyone else, thank you for your answers, I appreciate all the information!

Do a search for forms of this nature, down load them, fill them out, and then sign it in front of the Notary! You don't need a lawyer to do it. It will only cost your time of clicking print, or download then print.

Check the sites below, they might help. If you know how one is drawn up, all you would have to do is get a copy of it, change the information, names, etc to fit your situation.

I really don't know about the cost. Its such a shame to be even discussing this, if you think the marriage is doomed (which obviously you do or you wouldn't even need to discuss this) then you married the wrong person. IF you love them, then trust that they love you and make a commitment that divorce isn't an option. Its not idealistic, or stupid, or naive to believe in your marriage. You could destroy it before you even give it a chance if you insist on this.

If you are serious, and honestly don't believe in your union, then you should speak with a lawyer, you want them to protect the assets you have and write you an agreement that offers you the best benefits. Doing it yourself might not protect you as well or offer you what you will want should you divorce.

Do you have alto of assets such as a home or condo, a size-able amount of money in the bank, stocks, etc? Because if not then whats the point?

You don't need to get ugly, I did answer the question. Sorry if you take offense to my answer. I was just merely stating a point that Its quite sad that people get married to people for the short term. But I wish you the best of luck.

A post nuptial is nothing other then a contract, and contracts can be written up by anybody. You can write up a contract and you both sign it along with a witness and have it notarized and it will be legally binding in a court of law.

I would imagine that if you go to a notary, that should be sufficient, and alot cheaper than a lawyer. Make sure that you have enough notarized copies of this too........one for each of you, and mayby another extra for you kept in a safe, secret spot. Best of luck to you..........
