Their is a company call redmonkeydesign.com that has a property rights claim on red monkey jeans. Even though they don't make jeans at all. And the (2)companies are not related at all. How can this be possible, and what can be done about it.

So from my understanding, they have a copywrite on the name "Red Monkey", not the jeans itself. So are the jeans in violation of property rights, because red monkey design and red monkey company are not connected in no shape or manner. With (2)totally different products. Martin Kosoho designs the jeans.

It doesn't matter if they make jeans or not. If they have a legal copyright, they can license it to others to manufacture product. Do you think Disney makes all the plush toys you see? No. They own the rights to the products and people pay a fee for the privilege of selling Disney products. Disney gets a cut and hopefully the manufacturer makes a profit.

They can if they Name "Red Monkey" or some portion of the logo on the jeans is trademarked.

It's a trademark. In this case they trademarked the name of a product. Perfectly legal and companies do it all the time. Do you think they have to wait till the product is on the shelves before producting it?

if they own the copyright or trademark, that has been properly filed, the name is theres to use or not use as they wish.
