i dont have a lot of money and i cant afford lawyers,im pregnant and the babys father is very well off, from an influencial family, and he is trying to make me stay in the country,im not american and i dont know american laws i dont know if hes trying to scare me or if its true.Please i need someone to answer this who knows what they are talking about.Im a few weeks pregnant and i want to go home to have the baby,can he legally stop me from leaving the states?can he force me to stay and give birth to my baby here?

Nope. He can't. But the longer you stay here, the more opportunity he'll have to try. Don't tell him anything. Don't say you're leaving. Don't say goodbye. Just get on a plane and go as soon as humanly possible.

If you're near a border, cross into Canada or Mexico and get a plane out from there.

Edit: Some of the answers below are just plain wrong. The fact that your baby is born in the US does NOT automatically entitle you to stay in the country. That is an old myth. And kidnapping? If your baby is born outside of the US, the father can't even petition for visitation in the states, let alone be granted custody, let alone charge you with kidnapping.

I really don't know why people bother to answer when they don't know the law.

he can't make you stay now but after the baby is born you must realize that you may have to bring him back or you could be charged with kidnapping

I am curious why you would want to take a baby out of the states away from a wealthy father who obviously wants to be a part of it's life

maybe you should be thinking whats best for your baby not for you Babies love fathers just as much as mothers
or you could leave now and tell him you had a miscarriage
BUT someday the baby will want to know him and you could get in trouble later

why did you get pregnant by someone here if you knew you didn't want to stay here sounds like you may be a little selfish

Having your baby here makes the child an American citizen, and allow you to stay here to raise the child. It also makes him responsible for child support payments - and gives him the right to see the child, but not raise it. Depending on what country you were born in, the child may be entitled to dual citizenship. But the United States doesn't offer dual citizenship. If you aren't born here you have to apply for citizenship and rnounce any former ties you have.

So consider what your needs and the childs are. you can always move in the United States to protect yourself - or, leave and don't look back. Your helath is important too.

No! Get home as soon as you can. He can't keep you hostage and if he tries to then go to the police. He's trying to get you to stay because when you have the baby here in the US then YOU and the baby become US citizens. Then you can become a leach on our tax system. We will pay all your medical bills for free, give you a place to live, pay for your food, pay all your utilities, pay you to sit at home and raise your child, THEN we'll pay you even more if you keep having children - but only if the father doesn't live in the same house, you know - the one we're gonna pay for.
If you want to go home, wherever that is, to have your baby in then go now. I'll buy you dinner when you come back to VISIT.

No, he can't. If you want to go than you are free to leave the country. If the child is born in the USA then he may be able to prevent you from taking the child out of the country by petitioning the court. If you want to leave than it is best that you do so ASAP.

hell no not here in the states he can't .now they might try to scare you into doing so .but this is a free country you can leave as long as you have not broken any of our laws.bye

No unless he has taken your passport or other records.
Only if he has a court order that the health and welfare of the child would be at risk if you were to leave.
