They will always be scared of everything, they are prey animals (meaning everything wants to eat them)
It is normal for them to roost in a tree, many fowl prefer to be off the ground at night, remember everything eats them.
The problem with the beak may be from him pecking something hard, like a rock and it may have chipped part of his beak off.
You will have to keep an eye on him, if he cant peck the food off the ground it may cause trouble in the future, if he starts loosing weight due to his inability to eat there isn't much that can be done to help.
Do you have a hen house for them? If so you can feed them in it late in the evening and them lock them up for the night. They DO have a better chance against predators if they are in a tree.
It is very rare that a fowl will freeze in the winter, even up in a tree.
