I ask because with everybody up in arms over video piracy, this seems to be a good question. I'm not in the US, and don't have access to much anime on TV - its usually the boring kiddy shows with little or no plot. I have downloaded fansubs, and don't see anything wrong with this, because someone has loved the series enough to take the time to do it - its also 'their' work they're sharing. And this is how I judge whether the DVDs are worth buying when they hit the shops here - they are usually $30-40NZ. So what do other people think?

I don't think so. Fansub usually capture the video from the TV show on Japanese and if the series was licenced, they stop fansubbing that series. Well thanx for the fansubber i can watch anime, because im not in japan.
If you download it you usually will see the message to not use the video for comercial use and delete the file after the series was licenced.

As long as the work you are downloading is not licensed out side of japan the copyright laws aren't strictly enforced. So it's not really pirated if you can't accsess it any other way.

not really...they are just made by obssessed fans...but they do violate copyright laws so what they are doing is illegal but only if they gain profit from it...

no because they don't get any profit from what they do. they do it to help other anime fans
