not sure, but i live in Florida. and i would say no. Especially if you signed a paper sayin you wouldn't get it back. Contracts are very difficuly to get out of, and i'm sure the price of a lawer/troubles and hassels of small claims court would be worse then just rubbin the vasoline off and going on!

The only to way to solve this is to check out your local Landlord/Tenant laws. They will be the only ones to give you a clear answer. But I realyl don't think you will get your money back. By signing the paper, you rpomised to rent the place, therefore having the landlord turn down all other applications. That is part of the security deposit, to secure the rent and whatnot for at least the first month

There is no way you are going to get that money back. Don't sign anything in the future if you are even the least bit unsure. Once you sign, it is all over. The judge would ask you one question and that would be, "did you or did you not sign this paper?" When you say yes, that's it. The judge doesn't care about why you decided not to rent it after you signed the paper.

I shouldnt answer this cause I am pissed at my last one, they kept $800 and to top it all off, they wanted to sell the place and gave me 1 month to move and my oldest son was getting married in a month, and I left the place spotless. I guess they can do what ever they want, I couldnt afford an attourney or I may have sued them. What a jerk Land Lords can be. I had another one that I didnt even have a contract with and didnt plan to move in for three months, they nearly kept it too, but his wife felt guilty I guess. (I had graduated from High school with her!!)

Nope, you sign the contract as a rental agreement to rent and you withdrew without their consent which makes it perfectly legal for them to keep the retainer. You better start reading everything on any piece of paper you sign.

I would say no. You acknowledged that when you signed the paperwork. A lawyer etc. would be a waste of time unless you're willing to pay a couple of hundred an hour.

You should be able to get it back...you might want to contact a lawyer and see what they say

He can keep it if you voided the contract. It's all about what's in writing not spoken.
