Yes, he sure can as the 17 year old is a minor, and he can be charged with rape, also what in the hell is a 33 year old man doing with a 17 year old girl? Know damn well what is on his mind, and better yet why would a 17 year old girl have anything to do with a 33 year old man, he's almost old enough to be her dad, eww gross, she needs to be with someone more her own age,

Yes. Every state has statutory rape clauses and 17 is the age.
Because of the difference of age prosecutors will not give you leeway like a 17 and 18 year olds having sex.

depends on what the laws on statutory rape is in your state. i met someone when she was 16 & i was 32. in texas, the age of consent is 17yrs. of age. we waited until she was of age & then began a wonderful 4 yr. relationship. (it only ended when she went overseas to study, but she was ready to go & explore the world. as her mentor, i knew that she was ready. that didn't make letting go much easier, but it was for the best.) she was taught about hygiene, pap smears, std's, positions & techniques, what is a good boyfriend/girlfriend/relationship, even how to make a good breakfast, etc.
finding a responsible, informed, considerate lover who has your needs in mind is a rare thing. if this is who your 33yr. old is, then you are fortunate to be able to have him & trust him. but most 33yr. olds are not this way. some can act one way & be another, especially with younger women. be careful. your ignorance can be used against you. one of the reasons that people are against such age differences in relationships is because the opportunity for the older persons experiences & knowledge can be used to screw up a younger person (and they'll never see it coming. why? they don't have the experience, yet! hell of a way to learn.). so, if you can't trust him not just with your heart, mind, body & especially, your soul, then wait for someone else.
now, having said that, if he is your true mentor, then relax & enjoy, 'cause he's got a lot to show you! good luck & clear sight!

It depends on the state, as a parent I would cut his small dick off...since he can't impress a woman his own age he needs to rape a confused sexual teen!

Honestly depends on the state...In Missouri 17 is the Legal consenting age...Some states it's younger some it's 18...either way, DON'T DO IT.

Yes she still under age. The laws state you have to be 18. If your over 18 and the person is under you CAN NOT HAVE WITH THEM NO MATTER WHAT
