i sold a mobile over the internet not on ebay but private which is unlocked the buyer asked if it was any network i said yes so i sold it to him he gave me money then he said phone didnt work on 3G which are different phones now he wants a refund which he says i falesy sold . under the sales of goods act 1964 but this only applies to traders as this was a private sale am i obiliged to him?

Wow this buyer sounds a right jerk.

I'm can't see you've done anything wrong. Your answer was in good faith and 'buyer beware' comes to mind. So long as you didnt state it was 3G, then your answer was correct in that it it is capable of being used with all available compatible networks.

Its a bit like someone buying a video player and wanting a refund because it wont play DVDs.

You will still be bound under distance selling act which enforces similar laws to the sale of goods act.

You say the law only applies to traders but you are a trader as you have completed a sale. Traders can carry out one or a thousand transactions - they are all engaged in the activity of trading in some ay or another.

He could take to to the small claims court but it would cost him around £300 to register his claim and get a hearing plus any solicitors fees so if he goes this far really depends on how annoyed he is.

I would recommend getting the item returned and refunding the payment then try selling it again with a more accurate description.
