The key provision is that you need to have knowingly disclosed information about a covert agent; so it would need to be proven that Plame was a covert agent and that Rove knew it and then told someone.

Plame was no longer a covert agent and there is evidence to indicate it was common knowledge that she was working for the CIA. This whole investigation (when viewed in context of the lies and political attacks from her husband Ambassador Wilson) appears to be more political than legal or national security related.

Bottom Line: If no law was broken (and it wasn't) there is no grounds for an indictment, no matter how much emotion or personal feelings someone wants to interject into the debate.

In order to get a correct perspective of your question you need to examine other questions and add up the common sense answers. Lets do the Math. What are the costs and benefits here?. What are the costs to the intelligence community of such an exposure nationally and internationally.? What are the costs to the image of America abroad? Can you imagine, a country's top official exposing his own government's secret agent? I don't care what level of involvement she had. Its shameful and disgraceful. Makes America a laughing stock. What are the benefits of the exposure? Who has gained by that knowledge.? Is the American public richer, better, more secure because of it? Everyone involved should be indicted. Whatever political gain was being sort it was the wrong way to go about getting it.

Its never been determined that she was even an operative. Just because you may work for the CIA doesn't make you and an agent. I think her hubby had more to do with any outing than anyone else.
