A person was driving through a parking lot with the hood of his van up blocking his view and he hit my parked car. Police report states that my car was parked. It cost me 3000.00 to fix my car. I had pl and pd insurance.

The person agreed to pay for my car but has since backed out. In the police report he admits fault.

yes, definately sue. Most laywers don't charge any fee unless you win, sue for your damages+fee.

Definetly. Simply go to your city's city hall or if you want to avoid losing a day of work and avoid headaches simply submit a claim with your insurance company pay your deductible and give any or all the information you have about the party who hit you and let your insurance company take the liable party to court through something insurance people like to call: subrogation.

If someone got the tag numbers on the van, pass that along to the insurance company. Let them do the suing. If no one got the license number, you really don't have anyone to sue.
