Hope that you are all right, I know what it is like to be invovled with a car crash (bike/car). Now first, stay calm because if you are frantic nothing will get resolved. Second was a two-lane or four-lane intersection. If it was a two-lane intersection and you were trying to turn left then it is the other driver's fault, But if it was a four-lane and you were trying to cross two lanes to turn left then some of the fault lies with you. If you were turning right on the two-lane intersection you most likely would not get into an accident, but if you were trying to turn right at the four-lane intersection and crossing lanes to turn right some of the fault will lie with you. But no matter what happens don't get into a panic most insurance policies cover some car crashes, if yours doesn't, get better car insurance.

...Why are you stating that someone was passing you in an intersection if you don't know the definition of an intersection? Be careful when you write up the accident report, and make sure you get in contact with an attorney.
Be that as it may, since I assume you were in front, it was illegal for the person who struck you to pass you when there were no lanes to go around...and therefore, the accident was his responsibility and the insurance should pay for it.
By law, a person passing by the first person in line at an intersection gives up the right-of-way and assumes responsibility for an accident if they are hit.

Contact the Department of Motor Vehicles in your county and pose this question to them. Or you could pick up a DMV road handbook. However, an intersection is usually defined as the point where two roads connect with each other. Best wishes...hope you weren't injured in this accident.

It is illegal to pass in an intersection, yes. But it sounds to me that you were trying to cross over 2 lanes to make your turn, which is also illegal; that is given that the one who hit you was not driving on the shoulder and that there was not a dual turning lane. But I think we can rule out the dual turning lane since you said it was unmarked. You should both get tickets it sounds like.

The citation does not really always prove guilt, civil and criminal are two sepeate issues, although one side getting the ticket can help, alot will depend on how the officer writes up the accident report.
Turn it over to your insurance who will contact thier insurance.

calm down. i practically get into trouble all the time. it's just bad luck. i found that if you're calm, it's easier to resolve. pray to who ever is the god of religion. never doubt and give up faith. just do those things and you'll be fine. it also helps if you concentrate on how to get out of the mess.

Are you okay? Someone hit me before and I was totally in shock, started shaking and everything. If you feel strange, please get checked out at a hospital.
