Ok here is my problem.....

a F 1 tornado ripped through Ohio where I live knocking half of a tree in my yard ON TOP of my car!! my husband and I live in a rental unit and are not sure what if any liability the landlord holds for this?
Also, we had NO insurance on the car.....am I able to try and get some now that it is damaged or am I pretty well screwed?

I was a professional tree man for 7 years, and he has no liability whatsoever for your car. It is considered an "Act of God," buy the insurance companies, and he does not in reality own the tree. Now, if the tree was decaying, he might be held responsible, but still doubtful. You are responsible for insuring your own items like your car. For example, if his house burns down with your stuff in it, you cannot collect from him when his insurance company covers his house, or his insurance company for your belongings. You have to have renters insurance (content insurance) for that. It's pretty cheap, even at the Big Boys like State Farm. I pay $18.00 a month for $2,000 in renters with a $1,000 deductible. It also covers me if someone comes in and slips on my welcome mat and breaks their leg. CYA (cover your ***) and get insurance on everything valuable you can afford. And you are pretty much screwed unless the area was considered a disaster area with government support, or maybe you can levy for support from the city if they have fund money. But that takes FOREVER for a response, and is usually peanut change.

And renters insurance does not cover your car in any way, unless it was inside the garage. But then they would still fight with you over it because you did not have auto insurance.

Your landlord is not liable because it was an "Act of God". If you get insurance now, the current damage will not be covered. The only way to get the current damage covered by insurance would be through lying and breaking the law. Unfortunately, I think you're S.O.L.

No you can not get insurance now that will cover the damage that is already done. The only thing you can do at this point is to talk with the landlord.

The tree belongs to the landlord? Then it is his responsibility to cover any damages that occured when it fell.
The only way he can get out of it is if you signed anything in your lease waiving personal property damage.
My mother used to rent a house. Her home owners insurance had a claim filed against it.
The lanlord, by law must carry home owners insurance.
Look into it!

Try taking the Tree to court or maybe the Tornado! LoL ... I think the Land lord should have Renters insurance that might cover you.

Ouch! It would be pointless to get insurance now... They would not cover it because it is a preexisting condition..... I would contact a lawyer in reference to the landlords liability. You could get lucky. Good luck and lets be thankful it was just something material that got crushed.

sorry to say honey, but without car insurance, you're totally screwed. Now, unless you have renter's insurance, you will have to foot the bill for repairs. I'm not sure that renter's insurance would cover that, but it'd be worth a shot if you do have it.
