this is something that only applies to little league ball in order to protect the catcher from bats that may ricochet off the backstop
in college and professional level baseball the batter can do whatever he likes with his bat as long as its not intentional, in which case he'd be totally ejected from a game and yes called out

No. That's only Little League and usually you get warned once. It's done to help young players(8-12) to learn how to hit. It gives them an incentive to hold onto the bat so no one gets killed in the stands.
