He's only listed as an occupant on the lease, with ME signing the lease. All the bills are in my name, and last night we had a confrontation about his guests he is bringing over, and his part of the bills that he owes. He keeps insisting that since he paid me 400.00 that when I said i'd use the 400.00 that I owe him to cover his portion of the rent for last month that he is owed a "credit", which was true, but it's no longer in effect. I keep trying to tell him this 'credit' has run out and we're still behind on bills but he won't listen and he's not keeping up with his portion of the bills. The argument got so bad, that he ended up physically putting his hands on me last night and had me down on the ground. The police were called, but they simply said "well, you chose him, we can't just throw him out if he's an occupant" What do I need to do? Do I have to continue to live with someone who's not a lease signer who's violent with me?

Bad question for a military member to answer, but hey can't resist. Look by law, your name is on the lease as the head of house right? Call the cops tell him you want him gone, put a restraining order on him, done. But other than that, tell him to get the hell out. Don't ask us, boot him out and send his stuff right out behind him. Don't break any of his stuff though, that may cause discruntle reactions. But a foot in his butt, is different.

Pack his stuff, put it out front with a note explaining that the lock has been changed and you've purchased a shiny new handgun.

everyone has a good point, but one thing. Get as much documentation together incase this goes to court. Courts need to see paperwork to see a good case in ure favor.

No you do not. Tell him to leave and then enforce it,, if there is no contract agreement you have the police remove him. Call your landlord and tell them he has to go.
