Hi,
This is about my friend who is on the verge of separation from her husband. The legal proceedings are going on. She is a working lady and has a regular monthly income. In their good times, she and her husband had jointly applied for a housing loan for a flat which is registered in the husband's name only. In such a case, is she not entitled to a share for this apartment. How can she claim her property ? Thanks.

She really needs to talk to an attorney about this. Since the apartment was acquired during their marriage, she may be eligible to receive 1/2 the value of it.

If they applied for a loan together, she would have had to sign a disclaimer deed. By doing so, she would have no claim on the the apt. or the equity.

The furnishings, car, bank accounts,stocks, and any other assets are 50/50 if they live in a community property state.

A lawyer could adviser her best.

She needs to contact her lawyer and see what her rights are in all of this as a married wife. She may be entitled to half but i am not exactly sure since i am not an expert on this matter and am not a lawyer.

Thats a good question. Normally I think it's 50/50 but she needs to speak with her attorney on this. Good Luck!

Depending on where they live, mostly everything is split 50/50. So they might have to sell.
