The EEOC is an agency of the Federal Government. As such, the Federal Government can "elect" if someone can sue them or not - and in most cases they don't allow it. The EEOC claims to be held by some kind of standard - but to some victims, it doesn't always look that way.

The EEO complaint is part of the administrative process to complain about discrimination. You should have received a copy of the EEO investigation and a decision letter. The letter should reflect your right to a hearing and your appeal rights. If you have exhausted all administrative channels, you can take the agency/business to Federal court and have your case heard. Be ready to wait a long time - it could take years to get through all of this. Good luck.
