can i get him for child support without doing a paternity test? if he wants one who pays for it? is it required?

I know he is the father of the girls...just wondering if i had to pay for the test..my caseworker wasnt sure...might as well make an *** of him :)

The laws about how conclusive having a man sign or be named on the birth certificate is in determining whether that man will be the legal father of a child vary from state to state.
In some states a man who voluntarily is listed as the child's father on the birth certificate is the child's legal father and has no right to later challenge it in court. In other states agreeing being named on the birth certificate as the child's father is only binding on third parties, and can be challenged by either the mother or named father. Some states require the challenge to be made within a set number of years after the child's birth, some states allow the challenge to be made at any time.
The only source for information as to your state is from your state's child support enforcement agency or an attorney in your state that does family law.

The way it went 6 years ago with my x and I was like this: he didn't sign the birth certificate but the test proved he was the father I signed up for child support and he had the choice to either sign papers saying that yes he was the father and he would help pay for her or he could sign his rights to her away which meant no contact no visits no nothing concerning her. He signed papers saying he was the father and pays his child support like a MAN should. It takes two to make a baby and if you're responsible enough to aid in creation then you should step up and help take care of that child, that's my opinion anyway.

yes people do know, it is easliy obtained , and if you don't want too , he can get a court order so that you have to show it.
My childs father wanted a paternity test , he put a court order out on me when she was 5 years old. I said yeah sure but i don't have the money to pay for it . He got a bit angry, so i told him , if he wasn't the father i would pay him back all the child support and all the court fees , his solicitor fees plus the cost of the paternity test.Everything went ahead and I was 100% confident about it other wise i wouldn't have arranged to pay for everything if he wasn't the father ...but that was an arraganemt we made together and he got it all drawn up with his solictor and mine. Well didn't I look like a total dummy when it turned out he wasn't the father.So I had to pay everything back, which is fair enough too. Why should another man have to pay. Even if you think you are sure he's the daddy, don't rely on mother nature. She let me down big time..lol

He doesn't have to pay child support if he denys your child. But a paternity test will have to be done because he did sign the birth certificate. If the paternity test proves he is the father, and he requests the test, then he will have to pay for the paternity test. But if he's not the father, you would have to pay.

Hello Kendra,
If the father admitted to being the father by signing the bc than you have a right to sue him for child support regardless of his challenging patternity (you'll most likely get back child support as well).
However, if he demands paternity testing, either the child support services or he himself will pay for it, not you:). Check with your state dept of children and families.
It is not required but he has a right to challenge patternity. Are you afraid that he may not be the father?

If He signed the Birth certificate, His responsible for the Child support.
If He wants to challenge that, he needs to go to court and request the DNA testing, Because he's the challenging the paternity, he's the one that Pays...
But if the DNA results is Negative..His lawyer can make you refund the Cost...The child support already paid is not returned.

So do you know if its his baby because if its not he doesnt have to pay anything but if he signed the birth certificate then im not really sure your better off getting a paternity test

He is legally responsible for the girls if his name is on the birth certificate, but that isn't a prerequesite for fatherhood. There are plenty of Dads that aren't on their kids birth certificates, at least they weren't around to sign them. It's all matter of report. If he wants a paternity test, he will likely have to pay for it. I hope that you can come to terms and I hope that he is interested in being a Dad for his kids sake. Best of luck.

If he deny's them in court then they do the test, if they r his then he pays. If he doesn't deny them, then they will set child support. If they turn out not to be his then you will have to pay for the test.

sure no test he didnt ask for it when on the certificate go to the local welfaare or social sevices they will warrant this guy and garnish his wages and help you get what the child needs
