You can't upgrade Windows for free and Microsoft's built a lot of anti-piracy controls into their software now. Basically your computer contacts Microsoft's servers every so often to identify itself and it's a lot easier for them to spot people with invalid licenses. So unless you want to keep your computer disconnected from the Internet all the time, you should go the legal route and pay for the upgrade.
