It depends on the organization's by-laws. It may or may not be legitimate, but the person elected certainly doesn't have to take the position it they don't want it.

Yes......but the elected still has to accept the nomination. If they never accepted the nomination, then their election is not valid. Read Roberts rules and regulations

Sure. That's how lots of people are appointed to positions.... they're not present to turn it down so they're elected in-absentia.
It's still their right to turn-down the position at the next meeting they attend though.
