If the act is not initiated by the reciever and it is consented by both, then is the act illegal? There is privacy so it cannot be considered public.

I'd be real nervous about sticking such a vital part into a hole with someone I don't know on the other side. I've heard of guys that were cut real bad by doing that stuff. Turned out to be a psycho on the other side of the hole.

if you are in a bookstore, it is not private.
a bookstore is a place of business with patrons.
so yes it is illegal. and the owner can lose his license if they allow it.
also you wlould be surprised how many states consider a bj an illegal sexual act!!!!! some of these laws are ancient.
