The standard MLS listing agreement, with a **that says if owner sells on own the office only gets 1% commission. Which is kinda mean because.. Well I'm not an agent BUT I work in a real estate office and I do all the ads for the listings and I do billing and I see the crazy amount of money that goes into the advertising of "your home" and all the work the agents do with open houses postcards, etc. I think If you want to sign with an agency, let them professionally market & sell your home for you & give them the commissions they deserve. :-)

Oh come NickR, you are obviously licensed and probably not very good at it. Explain to all us how you “negotiate a non-refundable deposit”, which is a contradiction in terms. Non refundable deposits are called fees.

Now to answer the question. Contrary to the other answers, you can use an agent and sell it by owner. In the industry it is called the unbundling of services. Assist 2 sell and Help U Sell are two national franchises of unbundled services. In many areas you can find a local broker that will charge a small fee and put your property in the MLS but not provide you with representation. You will place and pay for your own advertising, hold your house open, conduct your own showings etc. Of course there is an advantage in being in the MLS, but it comes at a cost. Forget the small amount you’ll pay the broker to get you listed on the MLS, what about the agent that writes the offer? They will need to be paid.

The contract you’ll use depends on the state you, or more specifically the property is in. Each state has different requirements for a sale and disclosure. If you aren’t experienced in this area you will need guidance, if not a agent/broker then an attorney or take your chances with what it probably your largest asset and perhaps find out the hard way later on what attorneys know about botched real estate transactions.

There are a few folks that can undertake this from the first transaction, but usually you would want to have help on the first one or two transaction to get a feel for the process.

Research, research, research then exercise great care.

There is two kind of contract in R.E., open list and exclusive listing.

Open listing is where the house is available to all the agents out there, and you have a agent that help you sort out all of your offers and contract. You can also sell the house on your own.

Exclusive listing is where you assign the agent full power on selling the house. Whether selling it on your own or with other agent, you'll have to go though your agent and pay him/her commission.

If this is the first time you're selling a home, its best to hire an agent to help you with the process. One thing you should be aware of is most of the people that are buying houses on their own are very experience, and very good negotiator. Having an good agent does help you better in negotiate better deal.

Most inexperience new buyer normally have an agent looking for a house, so you probably not gonna get some naive, high offer from inexperience house buyers.

If you sell your home thru a real estate agent - that is NOT a for sale by Owner. Realitor's charge anywhere from 3-6 percent of the selling price of your home. For Sale by Owner, you do not have that cost - - and you could possibly help the buyer with some of their closing cost. Check out Homesbylender.com or 4salybyowner.com - or just do a search with for sale by owner and you will get many many hits, these are normally free to list your home.... A Broker and their processor can do all that a realitor does, with the purchase .

As long as you can establish the market value of your home, have a title company, home inspection company, termite inspection company, ability to check credit on the buyer, negotiate a non-refundable deposit, and be there seven days a week 9:00 A.M. to 8:00 P.M., it should not be a problem.

if it is "for sale by owner" that means that you are not using a realtor to sell your home, you are selling it yourself. if you want to hire a realtor to sell your home, then it is not a "for sale by owner". your realtor will provide you with the necessary forms.
