Frivolous lawsuits are never a good thing (and are the demise of our legal system), but if you seriously choked on a foreign object then someone should be contacted about it. I would have first brought it to the attention of the restaurant manager and then notified their corporate office. After that, if they weren't able to satisfy you, I might contact an attorney. When I was pregnant with my first child, I went to a salad bar and picked out a deviled egg (there were like 50 of them, and with my rotten luck I chose the bum one)...I bit down onto a screw that was blended in with the yellow part. Since I was pregnant and hormonal I was probably more concerned than I needed to be about it and, honestly, I could have chipped a tooth or something. But I told the manager, and he very politely explained that after they had mixed the egg stuff up earlier they noticed that a screw was missing from the blender but never imagined it had gotten into the food. He was really concerned and comp'd the whole meal, and that was good enough for me. I don't think we need to go overboard on these things, mistakes and accidents happen. And if we continue to take advantage of these things and file all these frivolous lawsuits, we all end up worse off in the end. Maybe they'll apologize and give you a bunch of free food coupons...isn't that enough if you weren't hurt?

I guess it depends on what kind of a person you are...did you swallow the object out of ignorance, or do it on purpose....Judging from your question, I assume you would sue because you are asking what to do first.....return to the resturant or contact an attorney.

Depends on what the foreign object was and its interesting that you don't say. I mean did you lose a piece of jewelry that fell in your food, pop a button that went "ker-ploop" in your soup? And obviously you are OK if you're on here asking about it. You pretty much don't stand much of a chance. Get a job and earn a living and stop looking for a lawsuit everywhere you go. Just keep buying those lottery tickets if you're looking to get rich quick, that'll work.

Learn to properly chew your food before swallowing. It is because people that jump from bad luck to suing a service establishment. you don't really hurt a bigger corporation, you just get somebody fired. And I wouldn't be proud of getting rich by choking, you might as well be Jenna Jameson in that case (she's a porn star).

I would return to the restaurant and if they don't acknowledge what happened then I would contact an attorney.

Save the item that you choked on...if it was a bone or something.
Contact the resteraunt corporate office and then contact a lawyer.

I would call them to acknowledge the incident, and then immediately contact an attorney.

I would go to the restaurant and then go from there as they'll need proof. Depending on how long ago it was, it might be hard to determine
