She will have to go through the court process to distribute the assets he has left. Everything has to go through the state if there is no will. I would suggest she call an attorney and a certified public accountant. The attorney will be able to tell her how and where to file papers to the state. The CPA will tell her what she needs to do to file his final tax return and the Estate Tax Return (if needed). If he doesn't have much say maybe a house and a car or something small then she shouldn't have to do much. If he has a lot of stocks, bonds, savings accounts, retirement, etc. she should definately hire an attorney. Check your state laws for more specific details of forms and steps to take. I'm sorry to hear about her loss. You are a good friend to help her anyway you can.

She does need to talk to a lawyer. in most cases without a will the assets go to the spouse of the deceased. If her parents were not together or her mother was also dead the assets would be divided equally between the children. The laws vary from state to state, so hiring a lawyer would be worthwhile.

Was her father married? If so, the wife legally has the right to all of his belongings. If he wasn't married, she should have no problem with his belongings, but she will need to contact a lawyer to get help with claiming any money he may have had. If he had any retirement accounts or insurance policies, she will have to find out who he listed as the beneficiary. I sorry for your friends loss...I hope she is doing well.

That's not true. In most states, when someone dies intestate, the court will appoint a trustee. The normal distribution is not to the spouse only but to the spouse and children. They need to contact an estate attorney pronto.

Usually the assets go to the other parent/spouse of the deceased
If not she needs to see a probate lawyer

If she can afford it, get a lawyer. The Feds will try to take control if they can. She will probably end up having to go to court for his estate.
