if my rent is paid by the court date can I be evicted under the grounds of non-payment considering the fact that NY state law requires that u pay your rent 5 days after the court appearance or get out...or would the eviction have to be under other grounds once the court date arrives...and can I lose my section 8 due to this situation

The laws are different in each state, but first look into the section eight rules. Just go online and find your answers there. Talk with a section eight representitive. If this is due to late rent payment, then you should be able to stay if you pay up right away. The problem is this: As a month to month renter you can be evicted with a thirty day notice for any reason at all. The landlord does not even have to give a reason. If it is a lease, then you have many more options. With section eight you have more rights than a renter not on section eight. I suggest you look up the rules right away. Pay your rent right away too. Then if needed you can go prepared with law to your court date. It is possible that the section eight representitive may support you too. That would be a huge step in the right direction. If you have only been late once or twice, section eight may decide you deserve another chance. If section eight thinks the landlord is behaving unfairly the landlord could lose the section eight landlord status. Most land lords which have section eight status do not want to lose it as it garentees a huge portion of the rent each month is going to get paid regardless. That is a huge incentive for them to work with you. Good luck. Also, go to your states renters laws. They are easily found by Goggle.
