It depends on the state and the judge. I been going threw this for years and they raise my child support every 3 years in Florida. If he has an increase in his pay since you last went to court then they should adjust it if it hasn`t been in 3 years. Contact Child Support Enforcement and they will tell you and sometimes help you in court. Also if you have had an increase it might even out that he might not have to pay any more than he`s already paying. They base in on both incomes and figure the difference between your income and his. In Florida the person paying child support has to pay at least 25% of there income.

I actually did this by getting an attorney and having my attorney contact his attorney. They will go through both of your incomes and bills. There is usually a percentage of his income that he will have to pay which is based on how much you make. This poses one really big problem- if he is making less than he did when the original support order was put through, your support checks could actually go down!!!
I would really hope your lawyer will give you all the information before it goes before the judge so you will be prepared. All that is necessary is for the lawyer to get you and your ex- to sign the agreement and have the judge sign it. Normally, you don't even have to appear. Good luck!!

an upgrade is possible only if he's making more money. don't count on alot though. your attorney may take up the difference and you may wind up with less after all is said and done with. if he's paying, leave it alone or he may flee. SERIOUSLY, HE MAY FLEE THEN YOU'LL GET NOTHING! if you need more money, try the welfare dept. they're there specifically for you. thats why you, your EX and me are paying taxes so YOU can live a better life at someone elses expense. if you truly deserve it, i hope you get it. if you don't, i hope you lose everything including custody of your child.

infant help and custody are 2 distinct themes. both might want to be court ordered. because your father became court ordered to pay infant help for your mom, it really is what he's doing. because you mom became granted custody of you via yet another court order, you reside with her. in case you pick to stay including your father, and your mom isn't prepared to allow you to achieve this, he would opt to bypass decrease back to court and petition that the unique ruling giving your mom custody be overturned. to make certain that that to achieve fulfillment, he would ought to prepare that residing including your mom is a probability for your existence and safe practices. So no, you saying you don't like your mom (as all little ones your age do finally) received't make a choose overrule an latest custody order.

all that will happen is that they will make both you show your income an than it will be based own that, it not nothing to worry about the worse part will be having to look at the ex, call your child support place see what they tell you, been there done that, they based it own both are income an he stop paying so i ended up getting most all his income tax, which made him really happy at me , good luck sure it will be fine.

my mom did this. it depends. if you have a good job that pays, and he has a good job, im not saying he has to be donald trump but he has to still be working. They will look at your finances and his, and why your asking for more money. Since shes living with you, you will probably get the increase. my mom did it twice, its not THAT big of a deal, its not a huge increase in money, but still it helps sometimes. GOOD LUCK
