My daughter was struck by a fallen tree and had to be taken to the hospital, althought she only suffered minor brusies. Is there anyone legally responsible?

Well, before going to the hospital my daughter complained of having back pain, she could not standup straight also pain in her leg and she could not move her toes. I only have state insurance, I didn't want to be stuck with the bill, if it wasn't covered.

If it was on your property then you are. If it was on a neighbor's property and it hit your daughter while she was on your property, then your neighbor MIGHT be responsible. If you are looking to sue, don't. The government doesn't need more lawsuites that really arn't worth it. It was only minor brusies after all. Sorry for your daughter.

A neighbor can only be responsible if you have complained to them that the tree was rotted..and looked dangerous..and asked them to remove it before something happens..Your homeowner insurance pays for your home and property....You can trim branches of your neighbors that hang over your property only. If it happened at a public place..ask about their insurance...but realistically if she only had MINOR BRUISES why take her to a hospital and why do you want to hold someone legally responsible....accidents happen in this world...if everyone when nuts because of minor mishaps..we would be constantly in the court house.

Usually the tree's owner (if it is on someone's property). If it is on publicly maintained land, the gov't might be... but there are plenty of exlusions for passing on public land at your own risk. Get a lawyer to investigate.

Acts of God should not be considered something to sue over. Come on. If she wasn't hurt badly then let it go. It is people like you who want to sue over every little thing that has gotten our country in the shape it is now. Let it go and thank goodness she wasn't hurt.

depends on whether the person who owned the land on which the tree sat was negligent in some way - but probably not.
