A Legal seperation is pretty much a divorce, but without the final resolution in case there is any chance of the marriage being repaired.

Meaning... You draw up legal documents saying who gets what, who pays who, who splits what etc... and then you go about your life until you get the final court date for the divorce.

As explained to me by my divorce lawyer... Legal Seperation is a waste of money and time. (Yes my lawyer said a waste of money).... Cuz when you go through a divorce it is simply the same exact thing.....

The ONLY time it makes a difference is if you have children, then you may choose to do a legal seperation so that their lives can become settled... etc, but again... it really doesnt make that huge of a difference...

Legal Separation Rules

you pay a lawyer, uncontested, $500 and up...he files papers in the court to "serve" your soon to be x husband these papers to tell him to LEAVE The house, take only his clothes; if need be call the police the day he is served, he may get pissed. A legal separtation has limits as to the contact each of you can have with each other not a restraining order just a set of rules that apply only to the separation period of the process of divorce. Just making him move isn't LEGAL you have to go through a divorce. If you reconcille (like I did) then you won't waste the courts time with a divorce. We had been married over 20 years when I had finally had it, after the papers came, and seven months of phone calls, gifts, and pleading, we are still together 27+ years all together. He changed some, not really enough to suit most, I do love him, he is a great father, sort out what you can and can't live with after the fact. Loneliness comes in all shapes and sizes. Good luck

You can also have a paralegal fill out the papers for you but you really need a lawyer. What it really means is you have to start working out custody arrangements, support, division of property. You can save some money and have someone you know serve him. But one good thing is that if he racks up some crazy bills you won't be liable.
