You must first think of the boy. He hasn't seen her for 3 1/2 years and it is going to take time for him to adjust to the new arrangements. I would at least let her see her son at the beginning for just a few hours a day. The hours of your choice and what is convenient for you. The child may feel uncomfortable to be around her at first because he hasn't seen her. You may want to ask him if he understands what is going on and how he feels about it. Then take it from there. If he doesn't want to spend the night with her, I would not force him to go. He is 9 years old and he might feel that his mom is a stranger.
You can ask a lawyer. Some lawyers will give you a free consultation before they take the case. Getting something in writing and legal for visitation would be the right thing to do. Problems may arise because of her being in prison you don't know what she was taught in there. If I was in your situation, I would give the child time to adjust to the idea of his mom being back into his life. His well-being and his safety are the most important thing right now.
Hope this helps and good luck!!
