I would suspect such a scheme is illicit if not illegal in your country. Why would anyone consider working for a employer that had such conditions for employment. Regardless, if you do consider it, you need to have a legally binding document as to exactly what the funds are deposit for and what are the obligations you have in order to receive the deposit back. The whole undated check thing just sounds wrong to me and I do not see how you can protect yourself with a live check sitting out there.

I heard of something similar long back but then when rpospective employee reported the same to court and filed complain, company settled the issue with out of court money.
