I'll bet you ten dollars it is Geico you are dealing with.
If not, thank them, they were the first company to really start doing that.
Tell the driver and the insurance company you are going to take the driver to small claims court for the balance.
If they send you a check for 1/3 DO NOT CASH IT. That is an agreement of the settlement.

If you truly were struck by the other vehicle & there was no fault on you, then you are entitled to be made whole by the other driver. If his insurance company is paying 1/3, then he should pay the remaining 2/3.
If he does not agree with this, then seek legal advice. You have a right to have things exactly the way they were before the accident & they have a legal obligation to make that happen.

Nominally speaking, your insurance company should be able to help you deal with this. But, I had a similar situation with a cut rate company, and I'll tell you who it is... SUPERIOR INSURANCE GROUP out of Dallas Texas, who after seitching my car insurance from one car to another, denied insurance on it after a drunk driver caused a wreck. His insurance company refused to pay for any damages to my car. I went to the DMV they did a hearing with me and an inverstigator and determined that the accident wasn't my fault at all. That made the other driver's insurance completely liable.

Get advice from an attorney and DO NOT cash any check sent to you as your endorsement of the check means you agree to the settlement amount. And they will leave you owing the rest.

You were hit from behind, and also you hit the vehicle in the front of you. the fellow who rear-ended you is to blame for the damage and tear to the rear of your vehicle. you're to blame for the damages to the front of your vehicle and the rear of the vehicle in the front of you because you've been too on the point of the vehicle in the front of you.
