Most states maintain statutes which specifically prohibit the possession of or use of an official state-issued identification card (like a driver's license) for the purpose of concealing one's identity or adopting the identity of another.

Generally such offenses are misdemeanors, punishable only by fines without any jail sentence.

However, there are special circumstances (using the ID to purchase alcohol, showing the ID to a police officer, etc) which can elevate the offense and provide for harsher punishments.

Also, the act of reproducing a forged ID card (either through showing up at the DMV with false documents, or making one yourself on a computer, etc) is generally a form of fraud or counterfeiting, and can be a felony.

Not to mention that the use of a forged or fraudulent ID to impersonate someone else is a form of identity theft and is governed by both state and federal law.

In California:
Driving with a fake driving license is a misdemeanor. First offenses are generally a year probation and a $2,000 fine. Second offenses get jail time and a larger fine.
Driving with a fake license when the real license was terminated or suspended is mandatory jail time for a first offense.
Use of fake driver's license to purchase alcohol by a person 18 to 20 years old: A first offense carries a penalty of revocation of the right to drive until age 21, and a hefty fine. A second offense gets jail time.
Use of a fake license to obtain goods or services worth more than $500 is a felony. Punishment can run from probation with community service and a fine to jail time depending on the circumstances.

it does vary from state to state, in ND its lateration of a ID, and no fine, unless you use it to buy alcohol ( most common) and then it is a minor in posessionl vilolation, $25 and commiunity service
