Ask another lawyer and explain everything that happened involving the representation of your lawyer. Ask about lawyers ethics, you might can report that lawyer to the state lawyers board. Get free consultations till you find another lawyer to represent your brother. Good Luck!

He has your money. Ok. Did he defend your brother? It would be really hard for you to prove that he did not defend him to the best of his ability. I would reccomend that you contact another lawyer. Seing as the other one has all of your money that shouldn't be. Why did you pay him everything up front. Isn't it policy that you pay part up fromt, and part later? To sue for malpractice look at this:
To determine if he/she has been a victim of legal malpractice, a client should ask himself/herself questions such as:

• Was my case dismissed because my lawyer failed to diligently pursue the case?
• Was my case dismissed because my lawyer failed to designate expert witnesses or failed to provide adequate expert reports?
• Did my lawyer force me to settle my case for an inadequate amount due to a conflict of interest?
• Did I get sued because my lawyer drafted a document or agreement that was improper or ambiguous?
• Did I lose my case because my lawyer drafted a document or agreement that was improper or ambiguous?
• Did the lawyer sign documents without my consent?
• Did the lawyer settle my case below the policy limits that were available?
• Did the lawyer use adequate "discovery"?
• Did the lawyer "dump" my case just before the statute of limitations ran out?
• Did my lawyer force me to settle out of court instead of going to trial because of his/her lack of preparation or experience?
• Did the lawyer prepare sufficiently for my case?
• Did I get an improper or inadequate settlement in my original suit?

Iam about to become licensed to sell prepaid legal insurance. Its just like home, auto, fire, and burial insurance. if you are interested please email me. once you become a member there will be attorneys to help with all your legal matters. You pay a monthly fee of about $39.00. and that monies goes towards attorney fees in the event you need them.
