depends if you are in a no fault state as others have said; unless you can prove and get admission of fault...
A little secret I'll pass along... once you have figured out how much it has cost you (loss of use, diminished value or total loss, time, doctors bills, loss of work, stress, pain and suffering) let your claim sit on the adjusters desk for awhile. They want everything settled ASAP and will offer a low-ball figure to settle and close your claim. There is a "secret formula" most insurance company's follow that they will never admit to. Assuming you are not injured too badly (loss of use of limb for example), take the damage amount to your vehicle (even a total loss; what was the car worth before it was hit) and multiply that by three and you have an approximate value for your claim. That should be in addition to all the doctor's bills they should have paid for your prior doctor's and therapeutic visits.
And good luck if your fighting with Progressive or Farmers. They are tight with their claims. As I said, the longer it sits, the more pressure on the adjuster to settle and close. They have to make you "whole"... completely satisfied. Let it sit for a few months if you have to. I was offered $7000 on a three year old car, which was close to the repair amount, and settled for $21,000. Same kind of accident, rear ended at a red light at about 40mph. Good Luck!

In rear-end collisions, almost universally the person who struck the back of the other vehicle is at fault. VERY hard to prove otherwise.

In Ohio, if you hit someone in the rear, you are at fault. If you are sitting still and someone backs into you, you are at fault. if someone pulls in front of you and slams on their brakes and you hit them, guess what? you are at fault. It is called ACD or assured Clear Distance. you are required to keep an ACD from the car ahead of you and if you don't, it's your fault. Sucks sometimes, but thats the law.

california is a fualt state and also nevada, the rest, i don't know
call the insurance of the other party and ask to have you car repaired and ask for compensation as well CA. or NV. i can help.

their fault. in back end collisions, the person who is behind is at fault 99.9 percent of the time. sue their insurance company and they'll fold.
